Institutional Ethnography on the Child Abuse Response Work of Public Officials in Charge of Child Abuse

본 연구는 2020년 10월 아동학대 대응체계의 전면 개편에 따라 아동학대 조사의 공공성을 강화하기 위해 현장에 투입된 ‘아동학대전담공무원’의 일을 탐구하고자 하였다. 아동학대 신고 건수는 지속적으로 증가하고 있으나 아동학대 판단율은 감소하고, 재학대 발생률은 줄어들지 않는 모순적인 상황 속에서, 대응체계의 핵심 주체인 아동학대전담공무원은 극심한 업무 중압감과 민원, 소송에 노출되어 평균 근속 기간이 13.9개월에 불과한 기피 직무로 낙인화된 실정이다. 본 연구는 이러한 현상의 원인을 개인의 전문성 부족이나 단순한 업무 과중으로 치환하는 기존의 관점에서 벗어나, 도로시 스미스(Dorothy E. Smith)의 ‘제도적 문화기술지(Institutional Ethnography)’ 방법론을 적용하여 아동학대전담공무원의 일이 거대한 지배관계와 제도적 질서 속에서 어떻게 조정되고 조직화되는지 그 ‘실제(actualities)’를 조망해 보고자 하였다. 이를 위해 입장 정보제공자인 아동학대전담공무원 7명과 2차 정보제공자 학대예방경찰관(APO) 및 아동보호전문기관 상담사 7명을 포함하여 총 14명을 대상으로 심층 인터뷰를 진행하였다. 또한 아동학대 대응 업무 매뉴얼, 관련 법령, 전산시스템(행복e음, 국가아동학대정보시스템), 각종 서식 등 텍스트 자료를 수집하고 현장 관찰을 병행하여 분석하였다. 분석 과정은 아동학대전담공무원의 일과 아동학대 대응체계에서 함께 일하는 주체들과의 조정양상을 포착하고, 일 지식과 함께 발견되는 텍스트 간의 위계적 조정을 추적하여 지침, 정책, 담론 등으로 인해 아동학대대응업무가 어떻게 조직화되는지를 발견하는 과정을 추적해나갔다. 또 연구자는 아동학대전담공무원의 입장에서서 아동학대 대응체계 너머에 연결되어 있는 사회와 연결을 찾아가기 위한 문제틀을 발견하였다. 이 과정에서 아동학대전담공무원의 일과 텍스트를 연결하고 모으는 작업을 진행하였다. 연구 결과, 아동학대전담공무원의 업무는 크게 세 가지 단계에서 제도적으로 조직화되고 있었다. 첫째, 아동학대 현장 출동 및 조사 과정에서 아동학대전담공무원은 「아동복지법」(복지 관점)과 「아동학대처벌법」(수사 관점)이 충돌하는 이원적 법체계 속에서 경찰과 이중 조사를 수행하며 업무의 비효율성과 대상자의 강력한 저항에 직면하고 있었다. 특히 아동학대 대응체계 내에 분리나 판단 등의 강력한 권한이 부여되었음에도 불구하고 실제 현장에서 보호자의 거부를 제어할 실질적인 강제 수사권이나 조사권은 미약하여 ‘강한 결정권’과 ‘약한 행정권(개입 및 조사)’ 사이의 괴리를 경험하고 있었다. 둘째, 아동학대 판단 업무의 조직화 양상에서는 ‘판단 척도’라는 계량화된 텍스트가 존재함에도 불구하고, 정서학대와 같은 모호한 사례에서 지침의 불명확성이 아동학대전담공무원의 재량권을 과도하게 넓히는 결과를 초래하고 있었다. 이러한 광범위한 재량은 결과적으로 판단의 실패를 조직이 아닌 개인의 책임으로 환원시키는 ‘조직 실패의 개인화’를 야기했으며, 아동학대전담공무원은 소송과 민원으로부터 자신을 보호하기 위해 점차 방어적이고 소극적인 판단을 내리는 ‘디커플링(decoupling)’ 현상을 보였다. 셋째, 사례 이관 및 종결 과정에서는 분절된 전산시스템(행복e음-아동정보시스템-APO시스템)으로 인해 핵심 정보 공유가 차단되어 있었다. 아동학대전담공무원은 시스템의 빈틈을 메우기 위해 유선 확인과 공문 발송 등 불필요한 행정 노동에 시달리고 있었으며, 개인정보보호라는 경직된 규범이 오히려 아동 보호라는 본질적 가치보다 우선시되는 비대칭적 권리 충돌 상황에 놓여 있었다. 이러한 분석을 통해 도출된 제도적 조정의 핵심은 다음과 같다. 첫째, 아동학대전담공무원은 아동학대 대응체계의 ‘허브’로서 모든 권한과 책임을 부여받았으나, 동시에 모든 비난과 법적 위험을 홀로 감내해야 하는 ‘취약한 고리’로 기능하고 있었다. 둘째, 아동보호의 공공성 강화라는 담론은 현장에서 아동학대전담공무원 개인의 사명감과 희생을 강요하는 방식으로 변질되어, 실무자들을 만성적인 위기 상태와 정서적 소진으로 몰아넣고 있었다. 셋째, 법과 지침 등 제도적 텍스트들은 아동학대전담공무원의 실천적 전문성을 지원하기보다, 절차적 정당성을 확보하기 위한 서류 작업에 공무원을 종속시켜 ‘주체적인 사회복지전문가’로서의 정체성을 상실하게 만들고 있었다. 본 연구는 이러한 논의를 바탕으로 다음과 같은 정책적 제언을 제시한다. 첫째, 아동학대전담공무원의 보호를 위해 개인에게 집중된 책임을 조직과 제도가 분담할 수 있도록 법적·행정적 보호 체계(소송 지원, 안전 프로토콜)를 제도화해야 한다. 둘째, 경찰-지자체-민간기관이 물리적으로 동일 공간에서 근무하며 정보를 실시간 공유하는 ‘통합 지원 체계(원스톱 센터)’의 확산이 필요하다. 셋째, 아동 보호를 최우선으로 하여 개인정보보호 규범을 유연하게 적용할 수 있는 특례 규정을 마련해야 한다. 넷째, 모호한 판단 지침을 구체화하고, 행정 서식 중심의 업무 구조를 대면적 실천과 변화 지원 중심으로 재설계해야 한다. 결론적으로 본 연구는 아동학대전담공무원이 겪는 고통과 업무 기피 현상이 개인의 문제가 아닌, 설계된 제도의 모순과 지배관계에서 비롯된 구조적 결과임을 가시화하였다. 본 연구의 결과는 아동학대 대응체계의 공공성이 실질적으로 작동하기 위해서는 실무자의 목소리가 배제된 텍스트 중심의 행정을 넘어, 현장의 실제 활동을 지원하는 유기적인 제도 개선이 선행되어야 함을 시사한다.

This study explores the work of public officials in charge of child abuse, public officials deployed to the front lines of child protection practice following the comprehensive reorganization of Korea's child abuse response system in October 2020, a reform intended to strengthen the public accountability of child abuse investigation. Despite a continual rise in the number of child abuse reports, the substantiation rate has declined and the rate of repeated maltreatment has failed to improve—a paradox that has coincided with the stigmatization of this role as an undesirable position, evidenced by an average tenure of only 13.9 months amid chronic work-related pressure, civil complaints, and litigation exposure. Rather than attributing this phenomenon to individual workers' lack of professional competence or simple work overload, as prevailing accounts tend to do, this study applies Dorothy E. Smith's methodology of Institutional Ethnography to illuminate the "actualities" of how the work of public officials in charge of child abuse is coordinated and organized within broader relations of ruling and institutional order. In-depth interviews were conducted with 14 participants, comprising 7 public officials in charge of child abuse as standpoint informants and 7 secondary informants, including Anti-Abuse Police Officers (APO) and counselors at child protection agencies. Textual materials—including work manuals for child abuse response, relevant statutes, local social welfare information systems (such as Haengbok‑eum) and the National Child Abuse Information System, and various administrative forms—were collected and analyzed in conjunction with field observation. The analysis traced the coordination between public officials in charge of child abuse and other actors co-participating in the response system, as well as the hierarchical coordination among texts embedded within this work knowledge, in order to reveal how child abuse response work is organized through guidelines, policies, and discourse. From the standpoint of public officials in charge of child abuse, the study identifies an institutional ethnographic problematic that traces how their everyday work is hooked into ruling relations extending beyond the child abuse response system into the broader society, through the ongoing assembling and connecting of workers’ activities with institutional texts. The findings reveal that the work of public officials in charge of child abuse is institutionally organized across three stages. First, in the process of on-site response and investigation, public officials in charge of child abuse must navigate a bifurcated legal framework in which the Child Welfare Act (a welfare-oriented perspective) and the Act on Special Cases Concerning the Punishment of Child Abuse Crimes (an investigation-oriented perspective) come into conflict, conducting dual investigations alongside the police and encountering both operational inefficiency and strong resistance from caregivers. Although these officials are formally vested with substantial authority—including separation and determination powers—their practical enforcement or investigative authority to override caregiver refusal remains minimal at the actual site of intervention, producing a persistent gap between "strong decision-making authority" and "weak administrative (intervention and investigative) authority." Second, in the organization of child abuse determination work, despite the existence of a quantified textual instrument—the "determination scale"—the ambiguity of guidelines in equivocal cases such as emotional abuse excessively expands the discretion of public officials in charge of child abuse. This broadened discretion, in turn, produces an "individualization of organizational failure," whereby the responsibility for determination failures is displaced from the organization onto the individual worker. In response, these officials increasingly adopt defensive and passive determination practices as a form of self-protection against litigation and complaints—a pattern of "decoupling" between formal decision authority and actual practice. Third, in the process of case referral and closure, the fragmentation of information systems (Haengbok-eum, the Child Information System, and the APO system) obstructs the sharing of essential information. To compensate for these systemic gaps, public officials in charge of child abuse are burdened with superfluous administrative labor, such as telephone confirmation and the issuance of official documents. Moreover, the rigid norm of personal information protection is often prioritized over the substantive value of child protection, generating an asymmetrical conflict of rights. The institutional coordination revealed through this analysis can be summarized in three key dimensions. First, while public officials in charge of child abuse function as the "hub" of the response system, vested with comprehensive authority and responsibility, they simultaneously constitute a "vulnerable link" bearing the full weight of blame and legal risk alone. Second, the discourse of strengthening the public accountability of child protection has, in practice, been distorted into a demand for these officials' individual sense of mission and self-sacrifice, driving practitioners into chronic states of crisis and emotional exhaustion. Third, institutional texts—including laws and guidelines—function less to support the practice-based professional expertise of public officials in charge of child abuse than to subordinate them to documentation aimed at securing procedural legitimacy, thereby eroding their identity as autonomous social work professionals. Based on these findings, the study proposes the following policy recommendations. First, legal and administrative protective mechanisms (e.g., litigation support, safety protocols) should be institutionalized to distribute responsibility currently concentrated on individual officials across the organization and system. Second, the expansion of an "integrated support system" (one-stop centers), in which police, local government, and private agencies operate within the same physical space to enable real-time information sharing, is needed. Third, special provisions should be established to allow flexible application of personal information protection norms with child protection as the foremost priority. Fourth, ambiguous determination guidelines should be made more concrete, and the current form-centered administrative structure should be redesigned to prioritize face-to-face practice and change-oriented intervention. In conclusion, this study renders visible that the suffering experienced by public officials in charge of child abuse and the avoidance of this occupational role are not individual problems but structural outcomes rooted in the contradictions of the post‑2020 public‑centered institutional design and the ruling relations that organize child protection work. The findings suggest that in order for the public accountability of the child abuse response system to be substantively realized, organic institutional reform that supports frontline practice—moving beyond text-centered administration that excludes practitioners' voices—must precede any further policy development.
