자진신고자 감면제도의 효과 : 대기업 변수를 중심으로

초록/요약
자진신고자 감면제도란 담합에 참여한 기업이 그 사실을 자진 신고하거나 조사에 협조하는 경우 시정조치나 과징금 등 제재의 수준을 감면하는 제도이다. 본 논문은 1999년부터 2014년까지의 공정거래위원회 홈페이지에 공개된 심결서를 이용하여 자진신고자 감면제도의 경제적 효과를 실증 분석하였다. 그 결과, 동 제도가 적용된 사건의 경우 추가적인 정보 획득의 효과로 인하여 과징금이 증가한 것을 확인하였고, 종속변수를 최종과징금뿐만 아니라 기본과징금을 추가하여 그 효과를 살펴보았다. 또한, 대기업 변수가 부과기준율 및 과징금에 미치는 영향을 보고자 해당 변수를 추가하였다. 이밖에 담합유지기간에 영향을 주는 요인을 토빗(Tobit)모형과 다중회귀분석(OLS) 모형을 활용하여 분석하였다.

The leniency program is to reduce the level of restriction for corrective action or penalty if participated company in cartel has voluntary reporting or cooperating the investigation. This paper, which includes the data from 1999 to 2014, explains actual analysis on economic effects of leniency program using the published resolution on the Fair Trade Commission(FTC). According to the estimation results, the case of the applied leniency program verifies increasing penalty as effectiveness of the program. Also, the paper includes the effectiveness of imposed penalty and standardized penalty. Moreover, in order to verify the big company and each industry affect to penalty, the paper is applied to big company and industry variables. As a result, big company influences to increase the penalty. The factor of influencing to duration of cartel is analyzed by using Tobit and OLS models.
