부통령제에 관한 헌법적 연구

우리나라는 대통령 중심제를 취하고 있음에도 불구하고 부통령을 두지 않고 국무총리가 부통령의 역할을 대신하고 있다. 우리나라는 제2공화국을 제외하고 제1공화국에서부터 현행 정부까지 대통령 중심제를 취하고 있지만, 제1공화국 당시에만 부통령이 존재하였고 제3공화국 이후부터는 부통령 대신 국무총리가 행정부의 제2인자의 지위를 차지하고 있다. 부통령은 대통령 중심제의 정부형태에서 대통령을 보좌하고 국무회의의 의장의 역할을 맡는 것을 우선적인 임무로 하는 자이다. 이러한 부통령 제도는 미국 헌법에서 그 기원을 찾을 수 있고 대통령 중심제를 취하고 있는 일부 국가에서 도입하고 있는 제도이다. 부통령은 대통령의 궐위나 사고시에 그 권한을 대행하는 것을 주된 임무로 하고 있으며 상원의장을 겸임하는 국가가 대부분이다. 부통령 제도의 모국인 미국에서는 부통령 제도와 관련하여 여러 번의 변화를 거쳐왔는데, 20세기에 들어서면서 부통령은 좀 더 성숙한 모습을 보이기 시작하면서 행정부 내에 일정한 영향력을 끼치는 사람으로 인식되기 시작한다. 미국의 부통령은 대통령과의 관계에 있어 원활한 관계를 유지하며 외교나 일정 부분의 각료회의을 맡아 그 운영을 담당하며 미국 행정부의 중요한 직책을 담당한 바도 있지만 대통령이 부통령을 그 견제세력으로 파악하여 그 권력 배분을 소홀히 하여 부통령의 자리를 사장시킨 적도 있다. 부통령의 권한이 대통령의 궐위시나 사고에 의한 공석이 발생한 경우 권한의 대행의 측면에만 한정시킨다는 것은 부통령 직을 공석으로 남겨두겠다는 것으로 파악할 수 있을 것이다. 현대 사회에 있어 국민의 민주적 정당성을 지니고 있는 부통령에 있어 일정한 권한을 부여하여 국정운영에 좀 더 긴밀한 협조를 구하는 것이 대통령 중심제의 올바른 운영이라고 할 수 있을 것이다.
우리나라에서도 제1공화국에서 부통령 제도를 경험한 바 있지만 운영상의 미숙함 때문에 부통령 제도는 크게 활용되지 못하였다. 또한 부통령과 국무총리가 동시에 존재하는 제도를 둠으로써 서로간의 권한이 중첩되어 부통령이 많은 역할을 하지 못하였다. 초대 부통령이었던 이시영은 이승만 정권에 반대하는 견해를 펼치다가 사임하였으며, 나머지 다른 부통령들도 특별한 권한을 행사하지 못하였다. 제1공화국 부통령은 대통령의 궐위시나 사고시에 그 권한을 대행하는 자이었으며 참의원 의장직, 헌법위원회의 의장, 탄핵재판소의 재판장을 맡은 바도 있으나 이승만 대통령의 견제에 의해 큰 역할을 한 바 없었다. 또한 헌법 및 법률의 구조상 부통령이 권한을 행사할 수 있는 기회도 주어지지 않았던 것으로 보여진다. 대통령 중심제를 취하는 우리 헌정사에 있어 부통령제를 처음으로 도입하였지만 부통령제를 제대로 운영하지 못한 것에 아쉬움이 남는다고 할 것이다.
그러나 최근 부통령 제도의 부활의 움직임이 일어나고 있다. 부통령 제도의 도입에 대해 부정적인 입장이 있기도 하지만 부통령 제도의 도입을 통해 대통령 궐위시에 민주적 정당성을 지닌 부통령이 그 권한을 대행할 수 있을 것이며, 우리나라에 팽배해 있는 지역주의를 극복하는 데 일조할 것으로 보여진다. 나아가 부통령 제도의 도입이 성별 간, 세대 간의 격차를 줄일 수 있을 것이다. 그리고 부통령 제도를 통해 국정운영을 경험한 바 있는 대통령 후보자를 배출해 낼 수 있는 기회를 가질 수 있다는 점은 부통령 제의 도입의 장점이라고 할 수 있을 것이다. 이러한 부통령 제도가 우리나라에 정착하기 위해서는 대통령과 부통령의 권한이 적절하게 배분되어야 할 것이며, 민주적 정당성을 지니고 있으며 국정 운영에 있어 대통령과 긴밀한 협조를 취할 수 있는 부통령제의 탄생이 이루어져야 할 것이다.

Though Korea takes the presidential system, Korea does not have vice president and prime minister takes the place of vice present’s duty instead. Korea took the presidential system from the first republic to current government with the exception of the second republic, where vice president was existed only in the first republic and prime minister held the second position of administration instead of vice president from the third republic. The preferential duties of vice president are to assist president within a form of government in presidential system and to take the chair role of a cabinet council.
The origin of vice presidential system can be found in a United States Constitution and it is a system adopted by some nations having the presidentialsystem. The major duties of vice president in most nations are to carry out as the acting president when he/she becomes vacant or involves in an accident and to hold an additional position as the chair of senate. The United States (U.S.), the homeland of vice presidential system, underwent several changes related to the vice presidential system. Vice president started to show more mature images as it enters the twentieth century and recognized as a person who contributes regular influences within the administration. here are cases where vice president of the U.S. maintains an amicable relationship with the president, takes charge of operation in foreign policy by carryinga fixed portion from cabinet meeting, and holds important duty in the U.S. administration. However, there exists a case where president grasped vice president as a constraining force and removed the vice presidential position by dividing authority inattentively. Limiting the vice president’s power as a proxy when the president is unoccupied or involved in an accident can be understood that the role of vice president is left as a vacant seat. In modern society, having vice president who holds national democratic justice, authorizing regular power, and demanding close collaboration for national administration can be known as the right operation of presidential system.
Even though Korea experienced avice presidential system in the first republic, the system was not further utilized due to immature in the administration. In addition, the system had both vice president and prime minister where mutual authorities were overlapped and vice president did not undertake many roles. The first vice president, Si-Young Lee, was resigned after extending opposite views to Seung-Man Lee’s government and the rest of the vice president could not exercise the special authority. The vice president of the first republic was a person who replaces the authority when the president is unoccupied and involved in an accident. He also took charge of the chair of councilors, the chairof constitutional committee and the judge of a court of impeachment, but he did not play a major role due to restraint from the president, Seung-Man Lee. By looking at the structure of constitution and law, it seems that no opportunity was given to the vice president to exercise the authority. Korea’s constitutional government having the presidential system was initially introduced the vice presidential system, but it is left as inconvenience for not managing the vice presidential system properly.
Recently, there exists an activity to restore the vice presidential system. Even though there exist pessimistic views for introducing the vice presidential system, vice president having democratic justice can carry out the authority when the president is unoccupied and it will be a help to overcome regionalism, which overflows in Korea. Further, introducing the vice presidential system can reduce both gender distinction and generation gap. In addition, the major advantage of introducing the vice presidential system is that there is a chance to turn out to be a candidate for the presidency by experiencing national administration through this system. In order to settle down the vice presidential system in Korea, the authority between the president and vice president should be properly divided, and the vice president having democratic justice and demanding close collaboration with the president for national administration should be established.
