Migration policy is one policy area of the European Union whose development should be understood in the historic and political context of individual member states and supranational entity formation. The principle of a single market and freedom of movement both characterize EU and also challenge the very nature of it. The fifth European Enlargement brought new horizon and challenges to the European Union since it is by far the largest enlargement which had the greatest impact on the membership and the territorial boundaries.
This paper thus seeks to engage in the discussion of the continuities and changes after the fifth EU enlargement. There are continuing efforts towards integrated EU migration policy and the fragmentation attributable to assertion of national sovereignty of member states. The new developments show that further move to harmonizing different national policies and simplified and integration EU level policy greatly facilitate EU principle of free movement of EU citizens and common external border control.
This Paper draws from various literatures in reviewing migration policy developments. In particular it will focus on “The Directive 2004/38/EC on the rights of citizens of the Union and their family members to move and reside freely” for further analysis of the EU migration policy.
