최저임금제는 지난 20여년동안 저임금 근로자들의 임금 상승에 중요한 기여를 해왔다. 그러나 현행 최저임금의 산정근거가 되고 있는 생계비, 임금수준, 물가수준 등이 지역편차가 매우 큼에도 불구하고 전국 단일의 최저임금제의 실시로 말미암아 지역별 임금격차나 물가수준 등을 제대로 반영하고 있지 못하고 있다.
또한 퇴직 고령자의 경우 근로의욕이 높지만, 이들을 고용하는 중소ㆍ영세 업체의 경우 획일적으로 책정된 최저임금이 상당한 부담으로 작용하여 고령자 고용을 기피하고 있는 실정이다
특히 07년 1월 1일부터 아파트 경비원 등 감시·단속적 근로자에 대하여 최저임금을 감액적용하기로 함에 따라 아파트 관리업체들이 인건비 부담 때문에 경비원을 줄이자 쫓겨난 경비원이 목숨을 끊는 사례가 발생하는 등 많은 부작용을 야기하고 있다. 이와 같은 문제점들이 하루속히 개선되지 않는다면, 한국 노동시장은 물론 경제 전체가 심각한 위험에 빠질 수 있다.
따라서, 시장원리를 무시하고 기업 현실에 눈을 감는 탁상정책 탓에 근로자들을 보호한다는 정책이 도리어 근로자들의 생존을 위협하고 있는 현상을 감시단속적 근로자를 중심으로 조사하여 문제점과 개선방향을 도출하고자 한다.

The minimum wage system has contributed to the wage increase of low-income laborers last 20 years. However, today''s unitary minimum wage system which covers the whole nation, failed in reflecting the local variation of the wage disparity because it doesn''t concern the fact that the basis of the minimum wage system, which consists of the cost of living, the average of wage, the price level, differ from areas exceedingly.
Besides, even though the retired elderly people want to work with a strong will, the small and medium enterprises evade hiring elderly people because the unitary minimum wage system is a big burden to the companies.
Moreover, the reduction of the minimum wage of guards and persons engaged in intermittent labor such as apartment guards since January 1, 2007 has caused serious side effects ; guard enterprises reduced employees to cut down the cost of labor and an outcast guard committed suicide after retirement. If we don''t try to solve these problems as soon as possible, not only Korea''s labor market but also the Korean economy can be in serious danger.
Accordingly, this paper will study the phenomenon that the policy to protect labor rather threatens the labor''s living because of an armchair theory that neglect market forces and ignore the reality of business concentrating on guards and persons engaged in intermittent labor, and analyze the problems and solutions.
