Terrorism has long been a concern of the global society. Yet it is only in recent years, with the greater scale and pervasiveness of contemporary terrorism, that a sustained global focus on security has emerged.
With the advent of the "war against terrorism," a number of counter-terrorism measures have been unleashed by the United States. The United States government has, inter-alia, increased the powers of law enforcement and intelligence institutions.
The primary concern of this study is that of how the 9∙11 terrorist attacks have influenced the United States government policy and what kind of implication can be drawn for human rights and the rule of law. This will be examined through the legal analysis of U.S. policy on detainees in Guantanamo Bay detainment camp, Cuba. Among a series of policies that the U.S. government has adopted in the aftermath of the 9∙11 terrorist attacks, the policy on Guantanamo Bay detainment camp draws most criticism. Guantanamo Bay detainment camp has become a symbol of human rights abuses and a synonym for a lawless zone due to its detainment of prisoners without trial and allegations of degrading treatment including torture.
However, the Unites States cannot deny its legal obligation to protect the rights of detainees in Guantanamo Bay detainment camp. Several legal regimes can apply to the Guantanamo detainee case simultaneously.
