This thesis analyses international norm setting against transboundary air pollution in Northeast Asia, focusing on the issue of acid deposition. The main objectives of the thesis are (1) to examine the international legal basis for controlling transboundary air pollution; (2) to analyze the development of regional commitments on transboundary air pollution in other countries; (3) to recommend strategies for norm setting against transboundary air pollution in Northeast Asia.
As the main goal of the study is to build up a legal model for Northeast Asian region by comparing actual legal regimes, the principal research method applied in this dissertation is comparative case study.
The rules of international environmental law, such as the principle of the obligation not to cause transboudary environmental damage, provide legal basis for the control of transboundary air pollution. However, as the mechanism of transborder air pollution is quite complicated, applying the principle to real situations is still difficult. Therefore agreements or treaties on transboundary air pollution should be concluded on a bilateral or regional level focusing on the specific situation of the case. This thesis draws three critical elements for the establishment of regional treaty to address transboundary air pollution in Northeast Asia: (1) the adoption of a framework convention; (2) the establishment of research network; and (3) the active participation of NGOs.
